PERA/ACA- ANOTHER DILEMMA?

The request for increase in PERA/ACA was simultaneously made with our salary increase in 2009. However, the latter was given priority since it is significant in terms of amount and fortunately we were triumphant in this aspect.

After the salary increase this July 2011, we tried to revive our request for increase in PERA/ACA but it seemed that another dilemma is in the offing because we did not receive positive result.

I just would like to raise for the sake of argument the following justifications on our demand for this PERA/ACA:

1. This is a statutory benefit enjoyed by all government employees as it is provided by law.

Joint Resolution No. 4 items 4(f) classifies PERA/ACA under

"(f) Standard Allowances and Benefits- These are allowances and benefits given to all employees across agencies at prescribed rates, guidelines, rules and regulations, which shall be limited to the following:

(i) Personnel Economic Relief Allowance -
This shall be given at Two thousand pesos (P2,000.00) per month,
the combined total of the current Five hundred pesos (P500.00) Personnel Economic Relief Allowance and
the One thousand five hundred pesos (P1,500.00) Additional Compensation, to supplement pay due to the rising cost of living;"

It is clear under JR 4 that the Standard Allowance for the PERA/ACA is P2,000.00 given to all employees across agencies at prescribed rate. When we say standard it is the base rate thus the allowance could not go lower than the standard.


2. The DBM circular No. 2009-3 dated August 18, 2009 provides for EXCLUSION which states that:

"4.2 Positions for civilian personnel in government agencies which are authorized by law to adopt, and are actually implementing their own compensation and position classification systems;"

The exclusion provided above presupposes that the granting of the increase is within the power of government agencies which are authorized by law to adopt, and are actually implementing their own compensation and position classification system.

This emphasizes the power/authority of the government agencies through their Governing Boards to approve their own increases in PERA/ACA as they are empowered by law under their respective charters.

This circular came out on August 18, 2009 during that time the LANDBANK Board still has the authority to approve increases in our benefits under the LANDBANK Charter. Between 2008-2009 and mid of 2010, we used to receive benefits either increase or one-time approved only by the LANDBANK Board.

3. The fact remains that other govenment agencies with separate charters already granted increases in PERA/ACA.

However, the sad fact remains that our management seemed adamant to grant us this increase despite the fact that the law under JR 4 itself provided for a standard allowance on PERA/ACA of P2,000.00.

The interpretation of the management on DBM circular 2009-3 will not clear the issue as it is self-serving.

As long as this issue on PERA/ACA is not unequivocably resolved through interpretation by the DBM of its circular specifically on the exclusion, the employees will continue to haunt the management on this issue.

......hi...gudevz to all....so madam sonia, it is in the golden hands of the DBM to re-phrase or to elaborate further the issued circular so that our management will be enlightened with this issue....and be guided accordingly.....By the way madam sonia, do u have idea about other gfi who are already receiving 2t aca/pera ? if ever tumatangap na sila, bakit tau di pa ???? jjejjejjejej

thank you ms. sonia for the info regarding the LBPEA NEB's negotiation on salary increase..

but we the "untogs" what also to know if our case was included as one of the major concern in the request?

We already received our salary increase and the NEB is not anymore negotiating on this aspect since the ranks benefited much except the "untogs". Our pending request now with management is the increase in PERA/ACA.

Regarding the case of "untogs", according to Mam Jojie our personnel department is currently reviewing the parameters. The untogs and those in PG 9 were affected during the salary increase.

However, let us also take into consideration the fact that our Board has no power to approve any increase in our salary and benefits, it is only Pres. Aquino through the GCG.

We cannot solve the "untog" issue if we do not have any basis at all. At most that we can do is to speculate because until now, we have no idea on the specifics of the newly implemented interim pay plan (IPP). Just asking NEB if what is their stand on this matter. Can't we not possibly request management for a data on the IPP? Talagang confidential ba ang subject na ito to the detriment of the institution? Have we formally requested for it in the first place?

I believe the LBPEA must do the inquiry or clarification from DBM pertaining to said JR4 so that LBP mgt. has the legal basis to release said statutory benefit of LBP r&f.

You did it for the salary which is more complicated, why not for this simple misinterpretation of the DBM Circular No. 2009-3 dated Aug. 18, 2009.

If you have particular problem on your salary increase, kindly write the NEB for us to refer the matter to our personnel department. Salamat po!

masarap na part talaga pag-usapan sa buhay nating mga bangkero ay tungkol sa PERA...nabuhay na naman ang mga lamang-lupa namin dahil sa mga isinulat ni Madam Tinkerbell...hehehehe....

may mga tanong lang po ako sa bagay na yan, BAKIT ANG PAG-IBIG, GSIS AT IBA PANG GOCCs AY NAE-ENJOY NA ANG INCREASE NG ACA/PECA???? sabi nga ng batas : "...to supplement pay due to the rising cost of living;" bakit sila lang ba ang nakakaramdam or apektado nito??? ang mga landbankers ba hindi ramdam ang tumataas na mga presyo ng mga bilihin, gasolina at marami pang iba???

management, maawa naman po kayo sa amin...oo nga po, malaking pasalamat namin sa dagdag sahod na ibinigay ninyo subalit ang sa amin lamang po ay naway nararapat lang na kung ano ang nasa batas, yun din po ang sundin natin...hindi naman po kelangan ng ano pang interpretasyon sa usaping ACA/PERA kasi nga po ay lahat tayo apektado ng rising cost of living na yan...naway wag ng umabot muli sa kung ano man ang nangyaring laban namin sa IPP...maging bukas lamang po sana ang inyong mga isipan...

Talagang unfair yang mga untog untog na yan bakit tayo uuntugin dapat across the board ang increase bakit may inuuntog. marami ring mga deserving ang di napopromote dahil sa mga procedure at reqs natin.yong iba dahil sa parameters,merong wala daw validation,kulang training etc. etc. untog tuloy.tsk. tsk.
