POINTS OF DISCUSSION:1. CNA Incentive –
a. Tentative date of release: On or before November 15
b. Amount
There will be a meeting today, October 21 at 1:00 P.M. between management and LBPEA regarding amount of CNA Incentive.
2. There was discussion on the possibility of requesting for additional benefit with the management as part of the CNA since we could no longer ask for additional grocery as it would require GCG approval.
3. Pay-out of Year-End Bonus on or before November 15
4. 3% Special Assessment
The issue on special assessment raised by Blitz in this website and similar concern which Atty. James Alilam posted in the facebook was deliberated during the meeting. However so as not to hamper the talks on CNA incentive today, Atty James forego the issue on technicality of the special assessment. There was also a written statement from Atty. Jonathan R. Amoroso- LBPEA Legal Counsel and a Labor Law Professor on the legality of the assessment.
The special assessment will be distributed based on our Constitution and By-Laws as follows:
a. 30% Operating Expenses
b. 20% Local Chapter(LBPEA Regional Chapter for projects)
c. 20% Education/Research
d. 15% Organizational Expenses
e. 15% General Assistance
This is also the distribution of the quarterly dues collected from the members.
5. KAMAGGFI letter to Pres. Aquino
A follow up letter to His Excellency regarding nullification of DBM Circular 2011-5 was sent by KAMAGGFI on October 2, 2013.
Background:
a. DBM issued the circular on December 26, 2011
Supplemental Guidelines on the Grant of Collective Negotiation Agreement (CNA) Incentive for Fiscal Year (FY) 2011
b. Representatives of Government Employees Associations sent a letter to PSLMC petitioning for the declaration of nullity of the DBM Circular on the following reasons:
-the circular contradicts the intention of the CNA to implement ways and means to generate income at lesser costs
-CNA incentive shall not be predetermined because payment is dependent on the savings generated
-the DBM should not unilaterally promulgate a decision on the grant of CNA Incentive since the same is a public sector labor relations issue which the PSLMC has the jurisdiction.
-the DBM did not consult the PSLMC members when it drafted the circular
c. The PLMC through CSC Chairman Duque endorsed the letter to Malacanang on April 26, 2013
d. The endorsement letter was forwarded to the Office of the DBM Secretary.
6. New CSC rules on retirement
CSC Resolution no. 1302242 was issued to make the retirement of state workers much easier. The amendment would require the agency Human Resource Management Office to submit the names of retirees to the Ombudsman and CSC for verification of pending cases within 1 month or 30 days after the employee has submitted his/her written expression of intent to retire.
7. Trade Fair/Booth at Head Office
LBPEA will be joining the trade fair or tiangge on November 19-29 at the LandBank Lobby.
