| REPORT ON The LBPEA NATIONAL EXECUTIVE BOARD MEETING October 21-22, 2010 By SONIA D. BROTARLO LBPEA Director for Visayas
The LBPEA National Executive Board(NEB) held its regular meeting on October 21-22, 2010 at the LANDBANK Plaza.
SELECTION OF HMO PROVIDER FOR 2011
a) Selection process for HMO provider is still ongoing. Thus, there is no chosen provider as of this time.
b) EMS Enterprise- HMO third party administrator Representatives from the company were given opportunity to present their products. Although, they were informed that our HMO selection is being handled by a committee composed of representatives from LBPEA, MMOAI, and top management.
COURT OF APPEALS UPHELD RTC DECISION ON COLA CASE
Atty. Norberto Martinez, COLA Lawyer, was invited to attend our meeting on October 22. He was so happy to announce the triumph of the case of Batch 1 before Court of Appeals and gave copy of the decision. He explained the procedure with which the case will go through and that LandBank may still file a Motion for Reconsideration. He assumed it will still reach the Supreme Court and estimated two years for the case to be finally settled.
Batch 2 is with the RTC Manila awaiting decision. He informed the NEB if there are interested employees who would like to join as petitioners and who were not able to execute SPAs before an intervention is still possible in this Batch.
ON BENEFITS
Year End Bonus will be given this November. LBPEA will be requesting for other benefits after the release of our bonus. There were rumors which reached the LBPEA NEB regarding release of additional grocery allowance and release of housing fund dividend. LBPEA has not made any request yet regarding additional benefits.
LBPEA NEB will still request for the release of housing fund dividend. However, we were informed that past due loans on housing fund escalated due to unpaid amortizations of retired employees. This fact would affect our dividend if ever release will be approved by PF Board.
TREATS NO MORE TRICKS
The Corporate Affairs Department in cooperation with LBPEA and MMOAI held its Halloween Program-Treats No More Tricks on October 22 at the Diosdado Macapagal Hall in the 10th floor of LANDBANK Plaza. The DM Hall was jam-packed with children of LANDBANKERS clad in Halloween costumes. There were costume contest and games.

The LBPEA website was shown through a projector before the NEB and issues raised were discussed by the LBPEA officers.

| Thanks for the information. We would like to request that the names of Batch I & II shall be listed here so that we will know. Furthermore, we request that the Middle Management shall suggest to the top management that the COLA case shall not be appealed anymore to the Supreme Court as this shall only give frustration to the employees. Anyway, even the top management shall received the benefits. Maawa na sila. Another proposal is for the LBPEA to appeal to the top management to grant or issue an Early Retirement package so that older employees could now avail and at the same time there shall be mass promotion due to this retirement package. | This is to verify why my name Manuel B. Buenaventura, did not appear in the list either Batch I or Batch II? How come? When all employees are actually affected by this COLA mess? I hope you include all regular employees. | |

| Sorry po Sir Manuel ilan din po kami sa LBPEA ay hindi included sa list kasi wala din kaming SPA.
May SPECIAL POWER OF ATTORNEY po kasi na pina circulate ang COLA advocates noong 2001 pa yata at VOLUNTARY po kasi ang membership may binayaran na P500 para sa filing fee and other expenses. Pagnanalo po 15% ng gross amount na tatanggapin ng mga petitioners ay para sa attorneys fees.
Ngayon po ang pwede pang magawa ay mag intervene sa Batch 2. However po, ang hinihingi ng mga COLA lawyers ay P1000 para sa filing fee and other legal expenses at 20% na contingent fee. Ang 20% ay ibabawas sa gross amount pag manalo ang case. Depende po kung tatanggapin ang terms na ito ng mga empleyado na hindi pa included sa list.

| Ano ang effect ng release ng COLA to those employees na bago pa lang...
ang kinakatakutan ko lang po pag ma release ang COLA is babagsak ang income ng LANDBANK.
affected ang bonuses ng mga employees at maaaring ika-bagsak ng rating ng landbank sa rankings...
ang narinig ko lang nito noon ayaw e-release nito dahil babagsak ang income ng landbank at maraming mag reretire na mga employees.. malaki kasi matatanggap nila eh... millions daw... | |

| For Alvin: Magkano ang pwedeng matanggap? Sa COLA P300/month from July 1989 plus interest. Mula 1989 hanggang kailan ay depende pa kung ano ang magiging final ruling ng supreme court in the event na ma elevate ang case.
For Cagayan: As to the cut-off, mula July 1989 po hanggang kailan hindi namin alam it could be up to the present depende kasi sa magiging ruling ng korte. Although ang petition po ng COLABEP ay bibigyan up to the present.
November 15 ang housing dividend not true po. Ang matatanggap lang natin this November ay ang year-bonus.
Ang housing dividend ay affected po ng mataas na past due sa housing loan dahil sa hindi pag bayad ng mga retirees. Hindi pa po na take up sa PF Board kung ibibigay ang housing dividend.
For noroshi: Ano ang effect sa bagong empleyado? If the newly hired employees would gamble and join as petitioners sa intervention, they can however subject to contingencies. Hindi tayo sure kung ano ang magiging ruling ng court pwedeng entitled din sila kung ang magiging ruling babayaran ang mga petitioners up the present.
Ano ang effect sa banko? Tama ka the bank's income will be affected. Kasi ang estimated na ibabayad ay P6B which is equivalent to our income last year. Kung babagsak ang ranking ng banko temporary lang naman. Ang mga regular benefits naman ay hindi maapektuhan. We dont know the actual impact of COLA in the bank's financial status we could only speculate. However, the bottomline is if the court should decide in favor of the employees then the bank has to pay.
Kung marami man ang mag retire then marami ang mabibiyaang mga jobless college graduates na gustong pumasok sa banko.
If the deceased employee is a petitioner then the beneficiaries may file a claim however it all depends on the ruling of the court.

Kailangan pa ba yung LBPEA intervention para doon sa mga hindi nakasama sa batch 1 and batch 2? Yung first page ng CA decision ang mga Petitioners-Appellees ay ... David Naval, Jose Ante, Alvin Arriza.... and Allan Benusa, In their own names and In Behalf of the Officers and Employees, both incumbent and retired, of the Land bank of the Philippines...ano sa tingin mo madam sonia? | |

| May point ka acpjr, ang kaso dito na naifile ay ‘Petition for Mandamus-for LBP to pay the petitioners the COLA and BEP” . RTC granted the petition. This ruling was affirmed by the CA with modification as to interest to be charged. The issue now at hand is whether or not those employees and retirees who did not sign an SPA stand to benefit in the event of finality of the decision. The answer lies on the party/ies named as petitioners-appellees and the final ruling of the court… kasama ba tayo kung sakali? I hope the union will clarify us on this aspect... Salamat po! | |

| According to Atty. Norberto Martinez-COLA Lawyer, only the petitioners will stand to benefit since based on RTC decision this is not a class suit but a petitioners' suit. The previous LBPEA did not file as petitioner for and in behalf of the rank and file employees when the case was filed in court. | |
