It has been two (2) years and six (6) months that this website was closed.  Many were disappointed with the closure but we have to keep up with the fast changing technology - facebook and twitter, among others.  
 
With the remaining one month and a half of my stint as Director for Visayas, I have been ruminative as to the manner of my “consummatum est” in LBPEA.  Thus  here I am re-opening the website pro hac vice for my grand exit. 
 
This is the medium where you first knew me and this is where I want to personally reach out to you to express my deepest and heartfelt “THANK YOU” for all the years that you trusted me.

LBPEA held its regular meeting last September 23-24, 2010 at the LANDBANK Plaza.

The Agenda for this September were as follows:

I. HMO for 2011

a) Invitation to bid for interested HMO providers were already sent by the HMO Committee. Our HMO Committee is composed of representatives from top management, middle management and LBPEA. Terms of Reference were provided to the HMOs and based on those terms they are going to give their bids particularly on the premiums they are going to charge. The terms of reference were presented to the LBPEA Board by Mr. Alvin Arriza-LBPEA representative to the Committee. One of the suggestions made was to do away with the incremental charges on hospitalization.

b) Proposal of Mr. Lito Chua on Third Party Administration of HMO - it was unanimously decided by the Board that the proposal will not be endorsed since it lacks thorough study. The proposal emailed by Mr. Lito Chua to different branches was made for the purpose of gathering comments and suggestions from the employees. The concept is really good but then their are problem areas disadvantageous to the prospective enrollees which need to be addressed.

II. Discrimination on crediting of PF Dividend - there were clamors from the R&F that officers' dividend were credited on the evening of Sept 22 while those of the rank and file employees were made early morning of Sept. 23. This matter was brought to the attention of the management particularly to Atty. Cervantes which he was not aware that it happened and he is going to check on it.

III. On our benefits - LBPEA will be requesting this 1st week of October for early release of grocery allowance.

IV. We had our meeting with Atty. Cervantes together with the heads of Personnel Administration Department and Employees Relations Department this was held on the whole afternoon of Friday.

According to Atty. Cervantes that our management and LANDBANK's legal counsels believe that we are covered by Executive Order No. 7. Infact, the allowances of our Board of Directors were already suspended. LANDBANK's Board is composed 7 members and 4 of whom are Secretaries of Departments appointed by Pres. Aquino.

We provided them with a copy of an article from Manila Times furnished by semaj501 in this website regarding the statement of Sen. Drilon.

In course of discussion the following issues were raised:

1. Whether or not our compensation plan with DBM was already scrapped with the issuance of EO 7?
Atty. Cervantes replied that it was just suspended in other words we will have to wait until January 2011 which is about 3 months away for us to make another follow-up.

2. Why LBPEA has no part in the preparation of the compensation plan?
LANDBANK commissioned a private company the Watson Wyatt to thoroughly study our compensation plan so that it should be comparable with the private sectors. Inorder to avoid complications, the compensation plan was not divulged to the employees. Atty. Cervantes made mention that we could only negotiate on the non-economic aspects of our benefits. Our salaries and other economic benefits were not part of our Collective Negotiation as they were excluded based on Civil Service Rules.
Atty. Cervantes added that TFCC created under E.O. 7 is now preparing for the rationalization of our salaries and benefits.

3. It was agreed by both LBPEA and the HRMG Group Head-Atty Cervantes that an information on our compensation plan will be circulated for the officers and employees.

So far those are the bullet points of LBPEA NEB discussions this September.

I just arrived from Manila and I was not able to log on these past few days because internet access at head office is strictly limited since a lot of negative reports were received that some employees were playing internet games, doing facebook and twitter during office hours.

For noroshi:

We are not scrapping the proposal but we need to conduct intensive research and study on it. There are other GOCCs/GFIs particularly DARAB and DBP who went into self-insurance but who are having major liquidity problems due to fund depletion. We do not want to experience similar problem as a result of an impulsive implementation without thorough analysis of the entire health insurance process. Hopefully after its fine tuning, we will be able to implement it but not in HMO 2011.

Gusto man po ng LBPEA na ipaglaban kayo pero wala po kaming magawa laban sa Presidente ng Pilipinas. Hindi lang po LANDBANK ang affected lahat po ng GOCCs and GFIs.

Kaya po nag meeting ang LBPEA sa management para ipaalam sa kanila ang hinaing ng mga empleyado. Pero dahil nga po sa EO 7 kaya hindi sila makagalaw. Ang assurance lang po sa atin na by January 2011 mag follow-up po tayo sa DBM kasi 3 months lang naman ang moratorium ng EO 7.

Ang hiningi lang po ng LBPEA na ang grocery allowance natin ay maibigay ng mas maaga.

Kung talagang covered tayo ng EO 7 dahil sa sinasabi ng nasabing EO na kasili kahit mga exempt entities, mag legal issue dito kasi parang may usurpation sa congressional power. Hindi dapat mas powerful ang EO kaysa legislation. Sa tingin nyo?

MANILA, Philippines—Sen. Joker Arroyo Sunday criticized the legal team of President Benigno Aquino III for racking up four cases before the Supreme Court in just 46 days in power.

“This is not a good beginning,” Arroyo said.

He noted that the President’s lawyers and Internal Revenue Commissioner Kim Henares should have not been “too overeager” in pushing their agenda that only placed additional burden on the Supreme Court.

The four cases pending in the high tribunal involve the first three executive orders issued by Mr. Aquino and his plan to impose a tax on road toll.

Executive Order No. 1, which created the Philippine Truth Commission to probe excesses of the Arroyo administration, has been stalled, with the minority bloc in the House of Representatives seeking a temporary restraining order (TRO).

Executive Order No. 2, which fired all “midnight” appointees of President Gloria Macapagal-Arroyo, has been challenged by Assistant Justice Secretary Jose Arturo de Castro and Subic Bay Metropolitan Authority director Eddie Tamondong.

Executive Order No. 3, which voids Executive Order No. 883 of the previous administration that automatically gave state lawyers Career Executive Service Officer (CESO) Rank III without taking CESO examinations, was also questioned in the Supreme Court by De Castro.

The imposition of the 12-percent value-added tax (VAT) on road toll that was supposed to begin on Monday was halted. The Supreme Court issued a TRO on Friday upon the petition filed by one of the VAT law authors, former Nueva Ecija Rep. Renato Diaz. Henares claims that the VAT on road toll is allowed by the Comprehensive Tax Reform Act of 1997 and the Expanded VAT Law.

In an interview on dzBB radio, Arroyo said that as much as possible an administration should avoid getting entangled in legal suits especially one as young as the Aquino administration.

“It is unfair to the Supreme Court because you are making its job harder,” said Arroyo, the first executive secretary of Mr. Aquino’s mother, the late President Corazon Aquino.

The senator cited as an example the refusal of Henares to heed the advice of VAT law authors like Sen. Ralph Recto and tax experts like Senate President Juan Ponce Enrile.

Arroyo said a legal suit could have been avoided had Henares agreed to defer the implementation of the tax on road toll by at least a week to absorb the other view from Congress.

“Congress and the executive branch should talk with each other before the TRO because both are part of the same government. A good lawyer who goes to court is not as good as one who avoids it as much as possible through negotiations. I don’t see why they want to bring the matter to the Supreme Court,” said Arroyo.

He said Mr. Aquino should understand the difference between the law and state policy.

“If the President thinks that a policy is not good for the government, he should not impose it. (With the VAT on road toll), he has already broken his campaign promise on no new taxes,” Arroyo said.

Impact on morale

He said the legal team should have given more thought to EO 3, not only to its legality but also to its impact on the morale of lawyers from the Department of Justice and Office of the Solicitor General.

“They would be hard to replace because you have to qualify the new ones again. The affected lawyers are those who would have defended the government,” Arroyo said.

EO 2 would also create a bigger problem for the government if the high court decided to revoke it and Malacañang’s appointees have to give way to the previous occupants of their posts.

“What will the government do with them?” Arroyo asked.

Overeager

“I don’t want to criticize the (President’s) lawyers because it is not fair to them. But they should not be overeager just like a bridegroom who cannot wait for his wedding night,” he said.

Arroyo then noted that President Corazon Aquino had a more high-powered team—notably former Senate President Jovito Salonga, former Sen. Rene Saguisag, former Rep. Teodoro Locsin, Jun Factoran and Dodo Sarmiento.

“All of them were trained in Harvard and we had zero problems with the Supreme Court because we do our homework,” Arroyo said.

He said that Cory Aquino’s EO 1, which created the Presidential Commission on Good Government, was approved without corrections from the draft of Salonga.

But Mr. Aquino need not get better lawyers, according to Arroyo. He said the President’s team should just take it slow and study its moves before taking any action.

“There is really no need to rush,” the senator said.

Frankly, I am not convinced that we are covered by EO 7 asopined by Atty. Cervantes and LBP Legal Counsel.

Senator Drilon, in a press conference held last September 8, 2010 quoted that EO7cannot cover the GOCCs which are exempt from the SSL because for at least 27GOCCs, their compensation is being fixed. The compensation of the employees isbeing fixed and decided by the Board of Directors by virtue of their chartersenacted by Congress. These are specific charters where the power to fix thesalary is in the Board of Directors. Theproposed EO cannot deprive the Board of Directors of the power to decide on thecompensation scheme of the GOCC. A LAW has to be enacted where this kind ofsalary structure of salary-exempt personnel in the GOCCs can be brought intothe review process, which shall be done by the Executive branch.

I am not a lawyer but I have thesame position as Atty. Semaj501 that EO is not higher than legislation. An EO cannot repeal what was approved thru legislation. Our charter was approved byCongress.

Anyhow, in as much as thereare two contradictory positions, why don’tLBPEA (being the voice of the rank andfile) should seek direct representation to the DBM or to the Office of Senator Drilon or to theBSP to clear the issue once and for all. We should not wait for January 2011 tomake a follow-up with DBM or just leave our faith to LBP negotiating panel. We,the LBPEA, should make the necessary move.

tanong lang po.... bakit po nagawa ng pag ibig mag approve ng additional grocery up to 85th approved na and to be released on oct 1,2010 when in fact isa sila sa mga gocc's na controversial with regards to salaries and benefits?bakit po kaya hindi magawa ng lbp?

Thumbs up ako sa suggestion mo apcjr. Dapat may Plan B ang LBPEA at di lang magrely sa kung ano ang stand ng ng kabila. It is also good to hear from Ms. Sonia that an information on our compensation plan will be circulated for the officers and employees. Ang tanong lang ay kung kailan… kasi with the adoption of Joint Resolution No. 4 & 26, series of 2009, di na maitatago ang sahod ng mga empleyado ng mga entities na exempt sa SSL. Ito ang provision ng item 9 ng sasabing resolution: [10] Disclosure of Compensation and Position Classification Systems Adopted by Exempt Entities – in conformity with the provisions of item [9] hereof, exempt entities shall submit their existing compensation and Position Classification System and their implementation status to DBM. In short, di na confidential by then ang ating mga sahod lalo na sa top management. Madadagdagan na rin siguro ang deposit level ng LBP kasi baka ililipat na ang payroll “nila” sa LBP.

LBPEA has already made a unanimous stand to follow-up our demand for salary increase on January 2011 for the following reasons:

1. We cannot afford to antagonize the DBM
Hindi po gusto ng LBPEA na pag-initan tayo ng DBM dahil po sa pagpumilit natin na ibigay ang salary increase. Baka po maapektuhan ang ating mga matatanggap na benefits within these 3 months. Hindi pa po tayo nakakasiguro na lahat ng tinanggap natin noon ay matatanggap natin this year.

Ang pangamba namin ay baka himayin ng DBM lahat ng benefits natin kasi meron pa po tayong benefits na although existing pero hindi pa nakita ang PF fund natin. Tumatanggap po tayo ng bank share na 30% ng basic salary na savings natin sa PFO at wala pong tax ito. Hindi po ito tinatanggap ng ibang empleyado sa gobyerno even ng taga DBM.

2. KAMAGFI -Kapisanan ng mga Manggagawa sa GFIs composed of representatives from the employees associations of Banko Sentral ng Pilipinas, Land Bank of the Philippines, Development Bank of the Philippines, PDIC, SSS, and PAG-IBIG recognizes the Executive Order No. 7.

According to VP External Nanet Lati who is currently the Secretary General of KAMAGFI, wala pong demand for any increase in salary and benefits from the different member-associations sa panahong ito. Ang pinangangalagaan nila ay maibigay muna ang mga benefits na tinanggap na dati.

3. The salaries and benefits of GOCCs and GFIs were in the spotlight lately
Ang salaries and benefits ng taga GOCCs and GFIs na tulad natin ay mainit na issue ngayon kaya nga nagkaroon ng Senate Inquiry. Although hindi si Mam Pico isinalang sa hot seat kasi reasonable naman ang mga natanggap natin. Hindi po kaya ng LBPEA na sirain ang magandang image ng LANDBANK sa Senado at banggain ang gobyerno dahil sa demand natin for salary increase.

4. We cannot imagine the consequences of defying EO 7
Hindi natin maalis ang pangamba kung ano ang maging resulta at epekto kapag ibalewala natin ang Executive Order ng Pangulo ng Pilipinas.

Ang pagsisi daw po ay laging sa huli kaya bago pa ito mangyari uunahan na namin.

LBPEA is making a firm stand at this time even against the ire of a few if only to protect the interest of the many.

We are not proposing for theunion to defy EO 7. What we are saying is that it may still be possible to present the issues or gut-feeling of the members to the “authorities” through our authorized representatives. Why? Because there appears a gray area on said order. Even the chairman of the senate tasked to study abuses of GOCCs/GFIs believes that exempt entities from SSL are not within the ambit of said EO as previously posted hereof.

Nevertheless, if the stand of LBPEA is the contrary belief, then we have no other option but to respect them. But then again, I reiterate my opinion that EO 7 could not be more powerful than the laws that were legislated by congress with regard compensation matters because, besides its plenary power to legislate, under Sec 5. Art. IX.B of our 1987 Constitution, it is stated that: “the Congress shall provide for the standardization of compensation of government officials and employees, including those in government-owned or controlled corporations with original charters, taking into account the nature of the responsibilities pertaining to, and the qualifications required for, their positions xxx The power, however, may be delegated to administrative bodies like when congress enacted our amended charter. Absent any delegation, no one but congress may set compensation plans.

LBPEA NEB is constraint to pursue an aggressive stand considering that even the Kapisanan ng mga Manggawa sa GFIs (KAMAGFI) is not doing anything to question the Executive Order. All GOCCs and GFIs are affected here not only LANDBANK. If there is one powerful group who could question the gray areas in this Executive Order, it is the KAMAGFI.

ng pangamba namin ay baka himayin ng DBM lahat ng benefits natin kasi meron pa po tayong benefits na although existing pero hindi pa nakita ang PF fund natin. Tumatanggap po tayo ng bank share na 30% ng basic salary na savings natin sa PFO at wala pong tax ito. Hindi po ito tinatanggap ng ibang empleyado sa gobyerno even ng taga DBM.

Napakaganda ng mga argumento niyo mga kapatid kaya lang sa aking palagay kahit maipilit pa natin sa lahat ng sangay ng gobyerno (DBM, Senate, Congress) ang ating mga hinaing sa ating compensation plan. Ang final approval pa rin ay ang President of the Republic of the Philippines alam naman natin na siya rin ang nag issue ng EO # 7 at maliwanag naman ang nilalaman ng EO sa ating lahat. May time frame naman ang review ng TFCC for the meantime lets enjoy working with our institution di naman affected ang ating mga benefits so far at nakakuha naman tayo ng 1 step increment this year, on the positive side di pa naman tayo aping api sa sitwasyon lets just hope and pray na maging favorable sa atin ang mga susunod na kabanata.....

I clear lang natin mga kapatid. Ang Presidente, sa aking pananaw ay walang kapangyarihan na mag prescribe ng sahod sa mga kawani ng gobyerno kung walang delegation mula sa congress. Kasi kung gagawin nya ito, may usurpation sa power ng congress. Sa saligang batas kasi natin, ang legislative power ay vested sa huli. Nakasaad pa dun ang specific na provision tungkol dito (Sec 5. TRANSCRIPT OF PRESS CONFERENCE OF SEN. FRANKLIN DRILON

DRILON: We have already finished the hearings of the Committee on Finance on the GOCCs. We conducted a total of 6 hearings--24 offices. We called 19 GOCCs and 5 GFIs. Apart from these personal appearances of these resource persons, we also sent out questionnaires to all of the GOCCs, wherein we sought information on certain aspects of their operation.

We shall now start the process of crafting the recommended legislation. We will propose to the Senate and the House a Public Enterprise Corporate Governance Act. This proposed legislation will review all 157 GOCCs and GFIs. We will have a Government Corporate Monitoring and Coordinating Council, which will be tasked to review the mandates of the 157 GOCCs. They will have the delegated authority to either dissolve or merge the mandates of the different GOCCs. They will have the authority to impose certain standards of performance for the appointment of the board of directors, so that we can have rules on the qualifications of the directors in the different GOCCs. We will also ask the proposed Government Corporate Monitoring and Coordinating Council with a review of the salary structure and compensation system of the GOCCs. This is our opportunity to make a review of the GOCCs because they constitute a major major sector of our government. As testified here, 43% of our national debt is owed to creditors because of the GOCCs. We have asked the DoF to submit to us the total assets of all the GOCCs; what is the total subsidy of the national government through the General Appropriations Act would be given to them; what are their annual revenues and how much of their revenues is remitted to the national government as dividends; and what is their total expenditure, because we are talking of a huge operation.

In India, they even have a Department of Public Enterprises. We don't intend to create a department which will monitor all of these GOCCs. In Singapore, they have a Temasek. It's a state-owned enterprise which in effect is the equivalent of a holding company in a private corporation. We will not even do that. We will just institute measures so that the abuses that we have seen will hopefully not be repeated, or at the very least be minimized. We will impose certain sanctions for failure to comply with the standards that the monitoring and coordinating council will come up with.

We have not decided on the composition of the monitoring and coordinating council. This is not new before it was there. This is a council that existed but it was toothless at that time and therefore nobody was following. We will intend to provide this monitoring council with teeth so that they can impose standards of performance. Compensation will be based on a set of performance standards that we will come up in the law or in the implementing regulations.

Hopefully before the month is over or before we adjourn for October 15, we should be able to submit this proposed legislation to the Senate and start the debate. Hopefully by the first half of next year, we should have a law already in place.

Tama marahil ang opinion mo atty. at naniniwala ako sa mga sinasabi mo sapagkat pinag aralan mo ang batas. Pero ang opinion kasi iba iba yan depende sa kung saan ka nakalugar. Iba rin siyempre ang opinion ng mga abogado ng management at iba rin ang opinion ng mga abogado ng administrasyon ni Pangulong Aquino. Ang nakikita ko kasi sa Congressional Joint Resolution # 4 maliwanag na sinasabi na bago mag implement ang GOCC/GFI ng anumang increse sa salary at benefits ay kailangan ng final approval ng President upon recommendation of DBM, ang resolution na ito ay ipinasa ng Kongreso kasama ang Senado. Ngayon sa tingin niyo ba kung kayo ang nasa lugar ni Pnoy pipirma ba kayo sa Compensation Plan ng GOCC/GFI gayong on going ang review ng TFCC dahil sa issuance ng EO # 7 na ikaw mismo ang gumawa. Opinion lang po ito at limited po kasi ang nalalaman ko sa batas.

Tama ka Fmartzano. Dadaan muna sa presidente ang approval ang anu mang balak na salary increase sa dahilan na naidelegate sa kanya ang kapangyarihan through JR No. 4. Sa mga araw na ito, dadaan sa butas ng karayom ang mga balaking pagpapaincrease ng sahod sa mga GOCCs.

Ang sa akin lang naman, baka pwedeng ipresent yung proposal for increase para sa mga rank and file muna. Sa tingin ko, may merito ang kaso ng mga rank-and-file - malayo kasi ang disparity ng sahod ikumpara sa SSL3. Pati nga sa PERA nila P2,000 na. Pag maparating sa attention ng Pangulo ang ganitong sitwasyon, baka iconsider nya ang proposal na increase. Pabayan na muna yung sa mga top officers dahil sa obvious reason na matataas na ang sahod nila. Tatamaan sigurado sila kung ipilit ang proposal ngayon.

The evil that EO 7 seeks to curb is the abuses of some GOCCS in giving "scandalous" salaries and perks. The general impression is that many, if not all, of these GOCCs have resorted to this scheme. This is not the case of LBP. In fact, even with the exemption from SSL, the salary of rank-and-file pales in comparison to SSL. This is very ironic di ba?

It is obvious that there is need for remedial legislation in order to stop these abusive practices that we have seen in the GOCCs. To start with the DBM the past leadership has failed to exercise its power under existing policies that could have prevent these abuses. Also the fact that there are already 157 GOCCs that are existing made the task difficult specially considering out of these 158, 26 are exempted from the salary standardization law. That is why we would propose legislation at the end of these hearings which would impose proper control on these compensation packages. We will not impose a gap but we will delegate to the President the power to fix the compensation package of the GOCCs. I repeat, the congress will delegate to the president the power to fix the compensation of the GOCCs upon the recommendation of the DOF, DBM but on the basis of reasonable standards that we will put in the law. Reasonable standards such as whether or not the GOCCs would be receiving subsidies fro the national government, whether or not they losing and other standards that the law may set. As of principle setting compensation and salaries is a function of congress but this function can be delegated as long as there are reasonable standards for the exercise by the president of such as delegated authority. Because we have seen the abuses that has happened, SBMA per the report of the DOF is one of the losing GOCCs and yet their executives are the highest paid in the entire bureaucracy. Of course subject to their further explanation, it would appear that their administrator was paid P26 million in 2009, P30 million in 2008 and P14 million in 2007. The same thing with the Clard development authority which they paid million of pesos. So we will come with the proposed legislation that will prevent such further abuses from taking place because we cannot allow this to go on. There are 158 fifthdoms existing which appears to be just appropriate public funds without mandate from anyone and not even would checked by the DBM and the president. This is the expense side. On the revenue side, it would appear that the present law which would require 50 percent of the dividends of the net earnings of the corporation should be remitted as form dividends is not being complied faithfully. RA 7657 provides that all GOCCs shall declare and remit at least 50 percent of their annual net earnings. This apparently not being complied with if we are to judge the dividends that be received by the national government. We would like in the next hearing to get accurate data of the amount of dividends that the GOCCs are remitting for the national government as the DOF appears to be at a lose as to exactly how much the dividends are due to government if the law is followed to the later. So we will continue the meeting on Tuesday august 24. At that time we will call on the executives concerns (GOCCs) in order to clarify and to explain such allowances and salaries they received which appears on the surface to be excessive and abuse of their discretion to set the compensation package for their own GOCCs. (including armand ariza) including him and that would give him opportunity explain. We also summon the SSS commissioners, DBP, MWSS and other corporations that we may decide to call.

Your are leaving it to the president to put a cap to this excessive?

We leaving to the president the matter of setting the compensation based on reasonable standards that we will put in the law. There is not cap because that depends on the discretion of the president based on the standards that the law will set. I will repeat, as a matter of principle, setting salaries is a function of the congress because congress appropriate funds but this power to appropriate funds for salaries can be delegated to the president as long as you provide for reasonable standards that should be followed because one of the things that we will require into is the amount of compensation of these members of GOCCs boards which do not appear at all anywhere and what are these: with the GOCCs would invest in private corporations as when SSS and GSIS invest in private corporations, members of their board would sit in the board of these private companies. These private companies would declare profit sharing in the form of bonuses at the end of the year. These bonuses which now the trustees GSIS and the commissioners of the SSS or the board of the DBP would receive is not reflected anywhere but is appropriated as part of compensation of these members of the boards. We will inquire into these because this would not appear in the COA. I know that certain members of the board of GFIs would sit in private corporations representing the GFIs equity in those corporations and yet the bonuses that they receive by virtue of their representing these funds in the different private companies are not turned over the trust funds much less reported into the COA. Nobody knows this.

Does remedial legislation will include per coa?

Yes that will be included in the legislation. At this point, I do not know yet in what matter. Maybe we will include in the delegated power of the president to fix the compensation package.

What's the liability of the GOCCs for appropriating these funds for themselves without any mandate?

Off hand and subject for further research. As a lawyer when a member of the board of directors of the GOCC would sit in a private corporation as member of the board by virtue of the equity investment of the fund, all bonuses should accrue to the fund that this board member represent and if they failed to remit this, there can be a case of malversation. (They can be made to refund?) in my view they can be made to refund and I must declare that these are bonuses that they receive while they are members of the board of private corporations where they sit by virtue of the equity investment of the GOCCs which the represent. For example, board juan dela cruz of the GSIS or the SSS would sit in the board of PLDT, SMC and these corporations would declare profit sharing to the board of directors in the form of the bonuses. In my view they should pertain to the trust fund which they represent specially if it is a trust funds because they sit in these boards not by their own investment but by the investments of the funds they represent. And therefore, the bonuses and the profit sharing that they receive as members of the board of directors pertain to the trust funds to the funds that they represent. And failure to remit can constitute malversation of public funds.

The dbm says they are having difficulty if imposing their policy on the GOCCs because of the many exemptions passed by congress , exempt from the SLL, would you remove all these exemptions?

The abuses are not necessarily on the salary. The salary could be within reasonable limits given the salary scale outside. What are being abused are the allowances which is not covered by the SSL. That's the problem and therefore, when we set reasonable standards, we should take into account all of these allowances that they would receive. The abuses that we saw is not necessarily rooted in their exemption from their SSL. It is from the fact that they have an untrammeled authority to set their own compensation schemes and it comes in the form of allowances other than salaries. In other words, the salary could be reasonable if you consider all factors but it is in the allowances that u see the abuses.

Part by the remedial legislation the abolition of the non-performing GOCCs?

We will look into that. I have not decided on that. First we will be requiring them to submit the list of the GOCCs which are being subsidized and therefore losing and the GOCCs which are profitable. In fact the subsidy that is found in the 2011 proposed budget is less than 50 percent of the level in the 2010 general appropriation act. From P14 billion to about P7 billion. We will craft a law which will cover this situation and plug the loopholes that we have seen.

...In the past they have tolerated it. They failed to exercise supervision either deliberately or through neglect or it's also possible that the GOCCs defied the action of the President by just doing what they are doing without regard to the limits that the President make. All of these are factual circumstances which we will look at further.

Ang katotohanan lahat naman ng ating mga hinaing tungkol sa ating compensation package ay naipaabot naman ng maayos sa management may mga series of communication naman at mga palitan ng mga sagot kasama na ang mga petition/position papers signed by some employees coming from different regions. Kaya lang ang top management may mga interes din kasing pinoprotektahan at may mga legal basis din silang pinaniniwalaan. Gayundin ang ating mga BOD ay puro presidential appointee kaya tingin ko wala tayong maasahan na gagawa yan ng hakbang na sa tingin nila ay maaaring di magustuhan ng kanilang amo na si Pnoy. Ngayon kung tayo naman ay gagawa ng mga hakbang na sa tingin natin ay karapatan natin siguradong hahadlangan din naman ng management ayon din sa kanilang mga karapatan lubhang napakahaba ng proseso niyan pag umabot pa sa legal battle, samantalang ang TFCC ay may natitira na lang na 60days para tapusin ang kanilang trabaho alinsunod sa EO # 7. Sa aking personal na pananaw antayin na lang muna natin ang susunod na mga kabanata at ang pagtuonan natin ng pansin ay kung paano natin mahihingi sa management ang mga benepisyong di pa institutional na ibinigay sa atin noong nakaraang taon at kung paano pa natin mapapadagdagan eto. Sorry for the delayed response...I have been tasked to perform an urgent assignment at the LBPEA Head Office for one week..limited ang internet access dito sa head office...

OCTOBER 15 is our Christmas Gift Raffle at 2PM
after this raffle is the crediting of our grocery allowance..

tama rin po c atty...kc compare sa mga teachers..malayo na po disparity ng basic salary nila sa atin..considering also..un aca/pera natin..na hindi nakikita na until now hindi tau nag increase pero lahat ng government employees nag increase na..

when we compare our basic to other agencies we will find out that others is superior over us and others is way below us. But please look at the total compensation package that we receive other NGA's don't have Provident Fund which is non taxable savings, they don't have Grocery Allowance, they dont have MIP1, MIP2 and MIP3. Now regarding Aca/Pera that is another item subject for negotiation outside of CNA, other item includes annual TAB of 30K which was approved by our board but still subject for approval of the President by virtue of JR # 4. It also include meal allowance raising from 750 to 1800 which is an increase of more than we ask on Aca/Pera. We negotiate one item at a time our main concern now is the Compensation Package. Actually napakaganda ng intention ng management dahil as early as before SSL 3 was approved the study of Watson & wyatt was already in place, the management wait for SSL 3 to compare our own compensation package recommended by Wyatt study and they found out na mas mataas ang SSL 3 so nagkaroon ng adjustment. It was presented to LBPEA annual convention submitted to DBM for review, well justified even in Senate Finance committee wala namang mag aakala na ang uupong presidente ng Pilipinas eh pag tutuonan ng pansin ang GOCC/GFI at mag issue ng EO # 7. Sa aking pananaw lang even if we question the legality of EO # 7 still the JR # 4 still in full force and effect pa rin so sa kamay pa rin ni Pnoy nakasalalay ang approval ng ating increase. Now, lets create a scenario, (gumawa tayo ng hakbang para labanan ang EO # 7 at nag back fire sa atin napag initan tayo ng DBM at nakapag create tayo ng hindi magandang relasyon sa Malacanang na siya ring may ari ng lahat ng GOCC/GFI,) Ano ang mangyayari? Di ba napakagulo lalo ng magiging sitwasyon? Fellow Landbankers lawakan na lang po natin ang ating mga pang unawa at ipagpasalamat natin na sa Land bank tayo nagta trabaho. At lahat naman ng ating hinihingi basta pwede lamang at naayon sa batas nakakamtan naman natin. Ito lang po ang assurance ng management sa aming huling pag uusap once na aproved ang ating CP ang stand pa rin ng management ay retro effective July 2009.

way below us....what i mean is mas mababa kesa sa atin siguro naman may mga availer ng salary loan sa mga branches niyo pwede niyo makita mga basic salary ng mga availers dyan na employee ng ibang Government agencies, mag re retire na pero ang basic 9thou to 13thou pa rin to name a few DENR & DPWH rank & file...at saka hindi "way below above us" check it again ma'am

Boss Fmartizano_lbp pasintabi lang po!!!Pakitanong naman po sa mga sinasabi nyong agency na mababa ang sweldo kung ano ang ginagawa nila sa buong araw sa kanilang opisina....cguro hindi naman lihim sa inyo na bihira na lang makakita ng araw ang iba sa ating officemates lalo na sa mga nadestino sa operation...kung sa lending naman hindi makatulog ng matiwasay dahil iniisip paano i propose ang mga account nila...so sana naman huwag mong i compare tayo sa ibang agency na sabi mo mababa ang sweldo....salamt po..
